Supply Sector. The supply sector is a business affected with public interest. Except for distribution utilities and electric cooperatives with respect to their existing franchise areas, all suppliers of electricity to the contestable market shall require a license from the ERC. (Sec. 29, RA 9136)

Supplier refers to any person or entity authorized by the ERC to sell, broker, market or aggregate electricity to the end-users. (Sec. 4 xx, RA 9136)

Introduction for the Jess Totten Report on the CREM


The Commission saw the need for conducting an independent pre-assessment of the current framework of the Competitive Retail Electricity Market (CREM) which includes a review of the rules issued by the Commission prior to its implementation.

For this purpose, the Commission, through the auspices of the United States Agency for International Development (USAID), engaged Mr. Jess Totten, the Director of the Competitive Market Division of the Public Utility Commission of Texas (PUCT) to perform the said task.

As such, Mr. Totten conducted his own assessment through a series of meetings in Manila with officials of the Energy Regulatory Commission and the Department of Energy and representatives of private-sector energy companies, a review of the rules and the conduct of fora with the industry stakeholders. As a result, the Commission now posts the report of Mr. Totten for the information of the public

PROMULGATED RULES

Revised Rules for the Issuance of Licenses to Retail Electricity Suppliers (RES)

Rules for Contestability -clarifies and establishes the conditions and eligibility for End User to be part fo the Contestable Market

Code of Conduct for Competitive Retail Market Participants – establishes standards of behavior for marketing electricity in order to protect customers. It also provides limitations on the relationship between DU and its Local/Affiliate RES, and ensures that the DU delivers non-discriminatory service to all customers, regardless of their choice of RES.

Rules for Customer Switching (previously referred to as the Uniform Business Practices) - set of rules promulgated by the ERC which prescribes the standardized business rules for interactions between the DU, PEMC, RES/Local RES, and SOLR relating to the commercial transfer of a customer from one RES/Local RES to another.

Rules for the Supplier of Last Resort - the set of rules that: (1) encourages contestable customers to choose their supplier of electricity upon the commencement of retail competition and open access; and (2) ensures the provision of continuous supply of electricity to contestable customers in the event of RES’ inability to provide electricity.

Rules on Rate Filing by the Supplier of Last Resort- provides the SOLR with a uniform filing system for applications by the SOLR for the approval of SOLR rate / charges to the affected Contestable Market, and to ensure recovery of the allowable premium and reasonable return associated with the SOLR service.

Competition Rules and Complaint Procedures – prohibits anti-competitive behavior and abuse of market power, and specifies the appropriate penalties and remedies for such behaviors.

Business Separation Guidelines (BSG), As Amended 1 of 4 , 2 of 4, 3 of 4, 4 of 4 – prescribes the clear separation of business operations and accounts between the regulated and non-regulated business activities of electric power industry participants.

Distribution Services and Open Access Rules (DSOAR) (Attachments: 6.1 Connection Agreement, 6.2 Generator Application, 6.3 Generator Agreement, 6.4 Easement Form, 6.5 Meter Ownership Agreement, 6.6 DWS Agreement) - pertains to the provision of services by a DU to captive and contestable customers, the RES, other DUs, and generators, under the new competitive environment.
