UPDATED, Notice, ERC Case No. 2009-007RM

Notice is hereby given that on April 21, 2009, the Commission issued a Notice of Proposed Rule-Making (Notice) setting the instant case for last public hearing on July 20, 2009 at two o' clock in the afternoon (2:00 P.M.) at the
ERC Hearing Room, 15th Floor, Pacific Center Building, San Miguel Avenue, Pasig City.

In the same Notice, all interested parties were given the opportunity to submit their comments (in both hard and soft copies) on or before May 15, 2009. Parties who have filed their written comments on or before this date shall be given priority during the public hearing. All written comments submitted thereafter shall form part of the records of this case and shall be considered in any action to be taken on this petition.

Accordingly, the Commission takes note of the following comments on the adoption of the Rules for Setting the Electric Cooperatives' Wheeling Rates (RSEC-WR):

1. The "Comments In Response To Notice of Proposed Rule-Making" filed by the National Association of
   Electricity Consumers for Reforms, Inc. (NASECORE) on May 14, 2009
2. The "Comment with Proposal for an Alternative Path of Implementing the Standard Initial Tariff' filed
   by Albay Electric Cooperative, Inc. (ALECO) on June 2, 2009; and
3. The "Comment with Proposal to Adopt an Alternative Path of Implementing the Standard Initial Tariff'
   filed by Sorsogon I Electric Cooperative, Inc. (SORECO I) on June 4, 2009.
4. The"Comment" filed by Aklan Electric Cooperative, Inc. (AKELCO) on June 26, 2009
