ERC on TransCo : We know what was required from TransCo by the law

“The Energy Regulatory Commission (ERC) knows exactly what the law requires from the National Transmission Corporation (TransCo),” Chairman Rodolfo B. Albano Jr. exclaimed. “This is not the first time that TransCo made embarrassing statements against the ERC. The ERC knows what it is doing and strictly adheres to its mandate. That is exactly the reason why TransCo was meted the amount of PhP9.4 million for having implemented several capital projects without the ERC’s prior approval. The ERC merely exercised its duty as prescribed by the Electric Power Industry Act (EPIRA),” the ERC Chair added. This clarification is issued in line with the allegation made by TransCo published in a major daily that the ERC is in difficult situation on what procedure to follow.

Section 9(d) of the EPIRA clearly and categorically provides that TransCo shall submit any plan for expansion or improvement of its facilities for approval by the ERC. “The law is clear and the ERC is not in any quandary as to what procedure to follow. It is probably TransCo who should carefully assess its action as it is the one who has difficulty understanding the law,” the ERC Chair emphasized.
