Notice
of public consultation on the proposed Rules for the Registration of
Wholesale Aggregators
Pursuant to Section 30 of Republic Act No. 9136, its Implementing Rules
and Regulations (IRR), the Philippine Grid Code, Philippine Distribution
Code, and the Wholesale Electricity Spot Market (WESM) Rules, notice
is hereby given of the holding of Public Consultation on the proposed
“Rules for the Registration of Wholesale Aggregators” on
March 31, 2006 at nine o’clock in the morning (9:00 A.M.), at
the ERC Hearing Room, 15th Floor, Pacific Center Building, San Miguel
Avenue, Ortigas Center, Pasig City. The proposed rules may be photocopied
at cost, during regular office hours at the ERC Main Office at the above
mentioned address or may be downloaded from the ERC Website at www.erc.gov.ph.
Relative thereto, the following procedures for public consultation shall be enforced by ERC:
I.) All interested parties may submit their comments (two (2) hard copies and one (1) soft copy) on the proposed rules on or before March 22, 2006 to Atty. Debora Anastacia T. Layugan, Officer-in-Charge, Market Operations Service (MOS) at dtlayugan@erc.gov.ph or spotmarket@erc.gov.ph or through mail to be addressed at 12th Floor, Pacific Center Building, San Miguel Avenue, Ortigas Center, Pasig City.
II.) Only those parties who have filed their written comments on or before the prescribed period shall be considered Parties of Record.
III.) All comments or questions shall be published on the ERC website.
IV.) The comments and questions received by the Commission need not be reiterated during the public consultation except for clarificatory purposes.
V.) No irrelevant requests for adjournment or delay shall be entertained. All Parties of Record are presumed to have read and examined the issues contained in the materials posted on the ERC website.
VI.) During the public consultation, the Party of Record shall limit its participation on the issues raised therein, which shall necessitate further comments. The Commission reserves its right to limit the comments or questions previously raised and answered. Additional discussion of detailed points is however encouraged.
VII.) After the public consultation, the Market Operations Service (MOS) shall submit its final evaluation to the Commission for its approval.
