Notice of public hearing on the Distribution Wheeling Rate Guidelines Regulatory Reset Issues Paper

Pursuant to Section 43(f) of Republic Act No. 9136, otherwise known as the Electric Power Industry Reform Act of 2001 (EPIRA) and Section 5 (a), Rule 15 of its Implementing Rules and Regulations (IRR), the Energy Regulatory Commission (ERC) promulgated the Guidelines on the Methodology for Setting Distribution Wheeling Rates, otherwise known as the Distribution Wheeling Rates Guidelines (DWRG).

Under Section 7.1.2 of the DWRG, the ERC must publish a Regulatory Reset Issues Paper embodying its initial views on the issues to be discussed during the pending Regulatory Reset Process, specifying the information required to be delivered and indicating the procedure to be undertaken by Regulated Entities for purposes of the Regulatory Reset Process.

Relative thereto, notice is hereby given that the ERC is issuing the Issues Paper for the Regulatory Reset for the Second Regulatory Period from July 1, 2007 to June 30, 2010. Said Issues Paper drafted by the ERC is scheduled for public consultation, particularly for expository purposes, on the following dates and venues:

1. October 10, 2005 (2:00 P.M. – 5:00 P.M.) at Ballroom A and B of Dynasty Hotel, Tiano-Hayes St., Cagayan de Oro City;
2. October 13, 2005 (9:00 A.M. to 12:00 P.M.) at Dagupan Electric Corporation’s (DECORP) Main Office located at A.B. Fernandez West, Dagupan City; and
3. October 14, 2005 (9:00 A.M.- 12:00 P.M.) at the ERC Hearing Room, 15th Floor, Pacific Center Building, San Miguel Avenue, Ortigas Center, Pasig City.

The said Issues Paper may be photocopied, at cost, during regular office hours at the ERC Main Office at the aforementioned address or may be downloaded from the ERC Website at www.erc.gov.ph. Moreover, CEPALCO, DECORP and MERALCO are hereby directed to have said Issues Paper available at cost (either in hard or soft copy [CD/diskette]) to interested consumers at their respective main offices.

Considering the complexity of the issues to be subjected to public consultation, the following procedure shall be enforced by the ERC:

I.) All interested parties may submit their written comments on the said issues paper (soft copies may be sent to info@erc.gov.ph) on or before October 28, 2005.

II.) Parties who have filed their written comments on or at least manifested their intent in writing to participate in the proceedings before the date of the scheduled expository public consultation would be given priority in participating in the said public consultation.

III.) Parties are not required to be represented by a lawyer but are strongly advised to have technical experts present with them during the public consultation with knowledge of accounting, finance, economics, engineering and pricing issues.


Thereafter, another set of public consultation would be held for purposes of discussing the inputs of the stakeholders on the said issues paper prior to the publication by the Commission of its “Preliminary Approach” on December 9, 2005, as follows:

1. November 14, 2005 (10:00 A.M. – 12:00 P.M. and 1:00 P.M. – 5:00 P.M.) at Ching and Chiu Function Rooms of Dynasty Hotel, Tiano-Hayes St., Cagayan de Oro City;
2. November 16, 2005 (9:00 A.M. – 12:00 P.M. and 1:00 – 4:00 P.M.) at Dagupan Electric Corporation’s (DECORP) Main Office located at A.B. Fernandez West, Dagupan City; and
3. November 18, 2005 (9:00 A.M. – 12:00 P.M. and 1:00 P.M. – 4:00 P.M.) at the ERC Hearing Room, 15th Floor, Pacific Center Building, San Miguel Avenue, Ortigas Center, Pasig City.


Finally, CEPALCO, DECORP and MERALCO are hereby directed to:

1.) post a copy of this notice, at least a week before the first set of scheduled public consultation in their franchise area, in: a) its Main Office; b) Branch Office/s; and c) at least three (3) conspicuous places within its franchise area;

2.) publish this notice in at least one (1) newspaper of local circulation within their franchise area a week before the first set of scheduled public consultation in their franchise area; and

3.) undertake other possible means of disseminating information to the public relative to the above scheduled public consultation on the subject issues paper.
